Overview
This Acceptable Use Policy ("AUP") governs the use of all services provided by VMHeaven ("we", "us", "our"), including VPS, web hosting, infrastructure, add-ons, and other digital services. By using our services, you agree to this AUP. Use of our services is also governed by our Terms of Service (ToS) and Privacy Policy.
Service Scope
VMHeaven provides unmanaged virtual private servers (VPS), KVM-based hosting, web hosting powered by Plesk, and related infrastructure services. Our services are intended for individuals and businesses seeking privacy-first, anonymous hosting infrastructure. We provide the underlying platform — customers are responsible for the management, configuration, and use of their own instances.
Permitted Use
Our services may be used for any lawful purpose. Typical permitted uses include:
- Hosting websites, web applications, and APIs
- Running game servers, development environments, or test systems
- Operating VPNs, proxies, or privacy tools for personal use
- Running legitimate e-commerce, SaaS, or business applications
- Personal projects, blogs, portfolios, and educational use
- Automated tasks, bots, and scripts for lawful purposes
Any use not explicitly prohibited in this AUP and consistent with applicable law is generally permitted.
Prohibited Activities
The use of our services for the following purposes is strictly prohibited:
CSAM
Hosting, distributing, or engaging in any activity related to child sexual abuse material.
Weapons, Drugs & Substances
Any content or services related to the sale, distribution, or facilitation of weapons, drugs, or illegal substances.
Malware & Cybercrime
Creating, hosting, or distributing malicious software (viruses, trojans, ransomware, botnets, etc.).
Phishing & Fraud
Any form of phishing, fake login pages, fraudulent activity, or deception.
Email Spam
Unsolicited mass emails, bulk mailings, or phishing emails.
Any activity resulting in blacklist listings (e.g., Spamhaus, URLHaus) may lead to immediate suspension or termination of the service.
Misuse of Resources
Any activity that negatively impacts the stability, performance, or availability of other customers or our infrastructure is prohibited. This includes, but is not limited to, excessive bandwidth usage or activities that significantly degrade system performance.
Illegal Usage & Abuse Reports
- Any illegal use under German law entitles VMHeaven to immediately suspend or terminate the affected service, without prior notice and without any refund.
- This applies to any form of legal violation, abuse, or breach of this AUP.
- Reports or notices of illegal usage will be reviewed and may lead directly to service termination.
Customer Responsibility
The customer is solely responsible for:
VMHeaven assumes no liability for damages, legal violations, or losses caused by the customer or any third party using the customer's services.
Monitoring & Enforcement
To maintain the integrity of our platform, VMHeaven reserves the right to:
- Monitor network traffic and resource usage for abuse detection
- Review reported content or activity upon receiving abuse complaints
- Remove or disable content or services that violate this AUP
- Cooperate with law enforcement authorities where required by law
- Suspend or terminate services without prior notice in cases of serious violations
We do not actively monitor the content of customer servers. Monitoring is limited to network-level abuse signals and response to third-party reports.
Traffic Usage / Fair Use
Customers must adhere to fair usage of network traffic. Excessive or abusive traffic that negatively affects our infrastructure or other customers may result in service throttling, suspension, or termination. Suspension and Termination
VMHeaven reserves the right to:
- Suspend services without prior notice
- Temporarily deactivate services
- Permanently terminate services
if there is a violation of this AUP, applicable law, or other policies (ToS, Privacy Policy).
Changes to this AUP
VMHeaven reserves the right to update this AUP at any time. Changes will be communicated to customers. Continued use of services constitutes acceptance of the updated policy.
Acceptance
By using VMHeaven services, you acknowledge and agree to this Acceptable Use Policy (AUP) and our Terms of Service.
