Anti-DMCA hosting: precisely what this line means

American copyright notices are recorded and go no further. That is the whole of the difference: the policy around it is the same one every VMHeaven server runs under, and it is short enough to read before you order.

The platform underneath

KVM · full root access

DMCA Ignored KVM runs on Intel with DDR4 ECC memory in Frankfurt and Amsterdam, on the same nine vCore tiers as Standard KVM.

DMCA has no force here

The statute is American and the machine is not. A notice under it is recorded, and it does not reach you as a countdown.

Orders that do count

A lawful order from an authority with jurisdiction over the server is a different document, and it gets acted on.

Crypto at the checkout

BTC, ETH, USDT, LTC, XMR and more, paid in advance with no ID check. The machine goes live as soon as the payment confirms on-chain.

Root, console, reinstall

Full root access, out-of-band VNC and a template reinstall: the panel is the Standard one, because the hardware is the Standard one.

03Platform

What you actually get

Notices are filed, not forwarded

We do not act on US takedown notices and we do not go looking through your disk. Network-level abuse signals and reports from third parties are what we read, and a report naming conduct the policy forbids is reviewed. One that only alleges copyright infringement stops with us.

The Standard platform, other ranges

Identical Intel silicon, identical DDR4 ECC memory and the same nine tiers from 2 to 32 vCores. What differs is the IP space this line is routed on and how notices about that space are handled. Nobody is asking you to accept slower hardware in exchange for the policy.

No single disk in the way

Flash storage sits on a cluster that keeps copies elsewhere, so an archive of 280 GB never depends on one drive staying healthy. Snapshots and the VNC console are in the panel where the rest of the range keeps them, which makes a bad update a five-minute problem.

Nobody reviews your project

Ordering does not open a conversation about what you plan to run: once payment clears, provisioning starts on its own, at any hour. What the platform forbids is written down in advance rather than decided about you at signup.

Volume is not the problem

Mirrors and media libraries move data, so the port runs from 200 Mbit/s on the entry tier to 10 Gbit/s at the top and nothing across it is billed per gigabyte. The line we actually draw is congestion: traffic that degrades the platform for other customers, not traffic there happens to be a lot of.

A straight answer before you buy

Ask on Discord, Telegram or email at any hour, and you will get a direct yes or no about whether a project sits inside this policy. We would rather say no in a message than suspend you a fortnight later, and the first reply typically arrives within the hour.

CSAM, malware and botnets, phishing and fraud, weapons and drugs, and bulk mail that gets the range listed on Spamhaus or URLHaus are forbidden on this line exactly as they are on every other one, and they end a service without notice and without a refund. The full text is in our Terms of Service. Weighing Amsterdam against Frankfurt, paying in crypto or running Windows? VPS in the Netherlands compares our four VPS lines city by city, paying for a VPS with Bitcoin or Monero walks through the checkout step by step, and offshore Windows RDP puts Windows Server on this line.

What happens when a notice arrives

The same four steps for every notice about a server on this line.

  1. 01

    We read what it claims

Every notice is checked for two things: what it says is happening on the server, and which law it relies on.

  2. 02

A US DMCA claim stops with us

A notice that only alleges copyright infringement under the US DMCA has no legal force here. It is not forwarded to you as a deadline, and nothing is taken down because of it.

  3. 03

    Abuse is handled as everywhere

A report of malware, phishing, spam, a botnet or anything else the Acceptable Use Policy forbids is reviewed and acted on here exactly as on every other line.

  4. 04

    Lawful orders count

An order from a court or an authority with jurisdiction over the server is acted on, and data is disclosed where the law requires it (Terms of Service §11).

07What's allowed

What's allowed on this plan

This line differs from the others in one rule: how US DMCA notices are handled. The rest of the Acceptable Use Policy applies here as everywhere.

DMCA notices

Not acted on

US DMCA notices are filed, not forwarded to you as a deadline, and content is not taken down because of them.

Scanning

Ask support first

Scanning is not part of this line's policy: it relaxes how copyright notices are handled, not the abuse reports a scan draws. Ask support before you start, or use Pentesting KVM, where scanning is allowed.

Always prohibited

On every plan

CSAM, weapons and drugs, malware and botnets, phishing and fraud, spam (unsolicited bulk e-mail), anything that gets the range blacklisted, and anything else illegal under German law. Any of it can end the service without notice and without a refund.

Refunds

As account credit

Consumers can withdraw within 14 days and get the unused share back as VMHeaven account credit. Beyond that there are no refunds. Goodwill is only given as account credit, at our discretion. Credit is never paid out as cash or a bank transfer.

The full rules are in our Acceptable Use Policy; refunds are section 07 of the Terms of Service.

Yes. DMCA Ignored KVM runs in Amsterdam from €5.99 a month, on the same Intel hardware as Standard KVM, with Linux or Windows Server. A notice under the US DMCA has no legal force in the Netherlands, and on this line it is not forwarded to you. Dutch law and our Acceptable Use Policy still apply in full. The same line is sold in Frankfurt, from €8.99 a month.

These servers are hosted in a jurisdiction where US DMCA notices have no legal force, and we do not act on them; other hosts call this anti-DMCA hosting. Content must still comply with the laws of the hosting country. Abuse, malware and illegal content are never tolerated.

The line is a policy about one kind of notice, not a way around the law. The DMCA is a US statute, and a notice under it carries no legal force where these servers stand, in Amsterdam and Frankfurt, so we do not act on it. Everything that is illegal in the hosting country stays illegal on the server, the Acceptable Use Policy applies in full, and a lawful order from an authority with jurisdiction over the server is acted on. Whether your own project is lawful is yours to check. We cannot give legal advice.

Yes, for anyone outside the EU: the server stands abroad, in Amsterdam in the Netherlands or in Frankfurt in Germany, under Dutch or German law, and your contract is with a business in Germany under German law. Offshore here means abroad, not outside the law. On this line it also means that a US DMCA notice has no legal force and is not forwarded to you; that is the only kind of notice the line does not act on. It is not bulletproof hosting: the Acceptable Use Policy applies in full, reports of abuse are reviewed and acted on, and so are lawful orders from an authority with jurisdiction over the server.

For the DMCA policy, neither: it is the same in both cities, because a US notice has no legal force in the Netherlands or in Germany. Choose by price and by where the people who use the server are. Amsterdam is the cheaper row, from €5.99 a month; Frankfurt starts at €8.99. Both run Linux or Windows Server behind always-on DDoS protection.

Yes, when it comes from a court or an authority with jurisdiction over the server. That is the difference to a US DMCA notice. Where the law requires it, we also disclose data to authorities (Terms of Service, §11): the data we hold about an account, which our Privacy Policy lists.

No. We do not inspect or store packet contents, traffic data or application-level information (Terms of Service, §12), and we do not actively monitor what is on your server. Monitoring is limited to network-level abuse signals and to reports from third parties (Acceptable Use Policy, §08).

Everything it forbids everywhere else: CSAM, malware and botnets, phishing and fraud, weapons and drugs, and bulk mail that lands the range on Spamhaus or URLHaus. A US takedown notice carries no legal force here. Any of those does, and ends the service without notice and without a refund.

US copyright notices are filed, not forwarded to you as an ultimatum. That is the whole point of the line. Anything naming conduct the AUP prohibits, or an order from an authority with jurisdiction over the machine, is reviewed and acted on. We do not inspect the contents of your server ourselves.

No, not in the usual sense. Only US DMCA notices are ignored: we do not forward them as an ultimatum and do not take content down because of them. Every other complaint (spam, phishing, malware, botnets, anything the AUP forbids) is reviewed and acted on, and so is an order from an authority with jurisdiction over the server. The line ignores DMCA; it is no shelter for abuse.

It means we keep what running the platform requires (billing records and network-level abuse signals) and nothing beyond it. We do not go looking at what is on your disk. Paying in crypto keeps a card out of the picture as well, if that matters to you.

Yes. Windows Server 2022 and 2019 can be picked at order time on every DMCA Ignored plan, the entry plan included. Windows takes longer than a Linux image to finish its first start; once it has, you connect over Remote Desktop as Administrator. It comes on a time-limited evaluation licence: activate your own key whenever you like. Offshore Windows RDP covers the rest. For Windows in Frankfurt, see Germany RDP.

Deployment is fully automated and starts the moment your payment is confirmed: no manual review, no waiting queue. A Linux VPS or a hosting account is online within about a minute; Windows Server needs a few minutes more, because its first boot sets up the system.

We accept card, PayPal or crypto (Bitcoin, Ethereum, USDT, Litecoin, Monero and more), at the same price for every method. Services are prepaid: no contracts, cancel anytime.
